Terms of Service

These Terms of Service (“Terms”) govern your access to and use of deyshine.com and any purchase of the Deyshine Smart Towel or related products (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms include an arbitration agreement and a class action waiver (Section 13). Please read them carefully.

1. Who we are

Deyshine is a brand based in Atlanta, Georgia. References to “Deyshine,” “we, ” “us,” or “our” mean the same.

2. Eligibility

You must be at least 16 years old to use this site, and at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By using the Services, you represent that you meet these requirements.

3. Launch pricing

Special launch pricing is a limited-time introductory offer and may change or end at any time without notice. Prices, product availability, and promotions are not guaranteed until your order is confirmed at checkout.

4. Orders, pricing, and payment

• All prices are listed in U.S. Dollars and exclude taxes and shipping unless stated otherwise. Sales tax is calculated at checkout based on your shipping address.
• We reserve the right to refuse, limit, or cancel any order for any lawful reason, including suspected fraud, pricing errors, or inventory limits.
• Payment is processed by our payment partners (currently Shopify Payments and Shop Pay). By providing payment information, you authorize us to charge the amount due.
• A discount code can only be applied at checkout and cannot be combined with other offers unless explicitly stated.

5. Shipping

We ship within the U.S. International shipping rolls out later. Risk of loss passes to you when the carrier accepts the package. Delivery estimates are not guarantees. See our Refunds and Returns Policy for damaged or lost packages.

6. Returns and refunds

Returns are governed by our Refunds and Returns Policy. Because the Smart Towel is an intimate hygiene product, opened or used items are final sale.

7. Health and product information

The Smart Towel is a personal hygiene product, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease. Information on the site is general; if you have a specific health concern, consult a doctor.

8. Acceptable use

• You may not use the Services for any unlawful purpose.
• You may not scrape, crawl, or otherwise collect data from the site at scale, or attempt to bypass rate limits or security measures.
• You may not impersonate another person, submit fraudulent orders, or use disposable or fake email addresses to stack discounts.
• You may not reverse engineer or attempt to extract the source code of the Services.

9. User content

If you post a review, photo, comment, or other content related to Deyshine on a public platform and tag us, you grant Deyshine a non-exclusive, royalty-free license to repost that content on our own channels with attribution. We do not claim ownership of your content. You can request removal of reposted content at any time by emailing us.

10. Intellectual property

The Services, including copy, illustrations, photos, the wordmark and sparkle mark, and source code, are owned by Deyshine or used with permission. They may not be copied, reposted, or commercialized without written permission.

11. Disclaimers

The Services are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Deyshine, its owners, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Services, even if advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the Services is limited to the amount you paid us in the twelve months before the claim arose, or $100, whichever is greater.

13. Dispute resolution; arbitration; class waiver

Informal resolution first. Before filing any claim, you agree to first try to resolve the dispute by emailing us at deyshinetowels@gmail.com. If we cannot resolve it within 30 days, either party may proceed.

Binding arbitration. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Fulton County, Georgia, or by telephone/video at your option.

Class action waiver. You and Deyshine agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.

Opt-out. You may opt out of this arbitration agreement by emailing deyshinetowels@gmail.com within 30 days of your first purchase with the subject line “Arbitration Opt-Out.”

14. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. For claims not subject to arbitration, the exclusive venue is the state or federal courts located in Fulton County, Georgia.

15. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date at the top of this page and, if material, notify subscribers by email. Continued use of the Services after changes means you accept the new Terms.

16. Severability and entire agreement

If any part of these Terms is held invalid, the remaining parts will remain in effect. These Terms, together with our Privacy Policy and Refunds Policy, are the entire agreement between you and Deyshine regarding the Services.
